{"id":27602,"date":"2026-03-27T14:48:50","date_gmt":"2026-03-27T19:48:50","guid":{"rendered":"https:\/\/icazalaw.com\/?p=27602"},"modified":"2026-04-07T12:07:16","modified_gmt":"2026-04-07T17:07:16","slug":"nueva-ley-513-pasantias-y-empleo-juvenil-formal","status":"publish","type":"post","link":"https:\/\/icazalaw.com\/es\/2026\/03\/nueva-ley-513-pasantias-y-empleo-juvenil-formal\/","title":{"rendered":"Nueva Ley 513: Pasant\u00edas y empleo juvenil formal"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\" id=\"h-sobre-la-ley-513-de-20-de-marzo-de-2026-que-crea-el-programa-de-pasantia-para-incentivar-el-trabajo-formal-de-jovenes-en-el-sector-privado\"><strong>Sobre la Ley 513 de 20 de marzo de 2026, que crea el Programa de Pasant\u00eda para incentivar el trabajo formal de j\u00f3venes en el sector privado<\/strong>.<\/h3>\n\n\n\n<div style=\"height:28px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"291\" height=\"300\" src=\"https:\/\/icazalaw.com\/wp-content\/uploads\/2026\/03\/image.png\" alt=\"\" class=\"wp-image-27605\" style=\"aspect-ratio:0.970048963433691;width:198px;height:auto\" srcset=\"https:\/\/icazalaw.com\/wp-content\/uploads\/2026\/03\/image.png 291w, https:\/\/icazalaw.com\/wp-content\/uploads\/2026\/03\/image-146x150.png 146w, https:\/\/icazalaw.com\/wp-content\/uploads\/2026\/03\/image-73x75.png 73w\" sizes=\"auto, (max-width:767px) 291px, 291px\" \/><\/figure>\n<\/div>\n\n\n<p><\/p>\n\n\n\n<p><strong>Por:&nbsp;<a href=\"https:\/\/icazalaw.com\/es\/expertos\/estefania-guardia-mendieta\/\" target=\"_blank\" rel=\"noreferrer noopener\">Estefan\u00eda Guardia<\/a>&nbsp;\u2013 Abogada<\/strong><\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-que-es-el-programa-de-pasantia\"><strong><u>\u00bf<\/u>Qu\u00e9 es el programa de pasant\u00eda?<\/strong><\/h4>\n\n\n\n<p>Es un programa creado mediante la Ley 513, dirigido a j\u00f3venes entre&nbsp;18 y 25 a\u00f1os,&nbsp;o menores de edad con t\u00edtulo de educaci\u00f3n media.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-limitaciones-en-la-contratacion-de-personal\"><strong>Limitaciones en la contrataci\u00f3n de personal<\/strong><\/h4>\n\n\n\n<p>Es de car\u00e1cter&nbsp;<strong>voluntario<\/strong> y pueden sumarse empresas nacionales, internacionales y entidades sin fines de lucro con sede en la Rep\u00fablica de Panam\u00e1.<\/p>\n\n\n\n<p>Para garantizar un equilibrio operativo, la ley establece cuotas de pasantes seg\u00fan el tama\u00f1o de la planilla as\u00ed:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Micro y Peque\u00f1as (hasta 50 personas):&nbsp;Hasta 2 pasantes.<\/li>\n\n\n\n<li>Medianas (51 a 100 personas):&nbsp;Hasta 4 pasantes.<\/li>\n\n\n\n<li>Grandes (101 a 200 personas):&nbsp;Hasta 6 pasantes.<\/li>\n\n\n\n<li>Corporativas (200+ personas):&nbsp;Hasta un&nbsp;3%&nbsp;de su fuerza laboral.<\/li>\n<\/ul>\n\n\n\n<p><em>Nota: Si tu empresa necesita m\u00e1s talento, se puede solicitar una autorizaci\u00f3n especial sustentada ante el Ministerio de Trabajo y Desarrollo Laboral.<\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-diferencia-con-una-relacion-de-trabajo-tradicional\"><strong>Diferencia con una relaci\u00f3n de trabajo tradicional<\/strong><\/h4>\n\n\n\n<p>La pasant\u00eda <strong>no<\/strong> constituye una relaci\u00f3n laboral y est\u00e1 sujeta a las siguientes limitantes, caracter\u00edsticas y requisitos:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Duraci\u00f3n:&nbsp;M\u00e1ximo 1 a\u00f1o.<\/li>\n\n\n\n<li>Jornada:&nbsp;M\u00e1ximo 40 horas semanales.<\/li>\n\n\n\n<li>Sin Pasivos Laborales:&nbsp;Al no ser una relaci\u00f3n de trabajo formal, no genera derechos adquiridos (salario, vacaciones, d\u00e9cimo tercer mes, prima de antig\u00fcedad).<\/li>\n\n\n\n<li>La retribuci\u00f3n que reciba el pasante no ser\u00e1 objeto de deducciones fiscales ni de seguridad social.<\/li>\n\n\n\n<li>Protecci\u00f3n:&nbsp;La empresa debe contratar una&nbsp;p\u00f3liza de seguro de riesgos profesionales&nbsp;privada para el pasante.<\/li>\n<\/ul>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"h-beneficios-fiscales-y-retribucion\"><strong>Beneficios fiscales y retribuci\u00f3n<\/strong><\/h5>\n\n\n\n<p>El pasante recibir\u00e1 una retribuci\u00f3n de&nbsp;<strong>B\/.450.00<\/strong> mensuales. Para la empresa, este monto es&nbsp;100% deducible de gastos&nbsp;para efectos fiscales.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"h-formalidades-que-las-empresas-deben-acatar\"><strong>Formalidades que las empresas deben acatar<\/strong><\/h5>\n\n\n\n<p>Todo se rige bajo un&nbsp;Acuerdo de Participaci\u00f3n&nbsp;estandarizado, elaborado por el Ministerio de Trabajo y Desarrollo Laboral.<\/p>\n\n\n\n<p>Al finalizar el periodo, la empresa emitir\u00e1 una certificaci\u00f3n que ser\u00e1 reconocida legalmente como&nbsp;experiencia laboral adquirida para el pasante.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"h-diferencia-con-demas-programas-de-pasantias\"><strong>Diferencia con dem\u00e1s programas de pasant\u00edas<\/strong><\/h5>\n\n\n\n<p>A diferencia de otros programas estatales, tales como Mi Primer Empleo, el financiamiento de la Ley 513 corre por cuenta de la empresa privada.<\/p>\n\n\n\n<p>Es un programa de pasant\u00edas nuevo e independiente a otros programas de pr\u00e1cticas profesionales que existen hoy en d\u00eda.<\/p>\n\n\n\n<p>La Ley 513 sirve como herramienta de cazatalentos para identificar talento fresco y ayuda a fortalecer la responsabilidad social empresarial, pues las empresas participantes ayudar\u00e1n a combatir el desempleo e
