26/04/2022- Article 2 of Law 284 of February 14, 2022 (hereinafter “the Law”) mentions and explains the guiding principles of the Horizontal Property Regime, which are:

- Respect for decisions.
- Respect for human dignity.
- Sustainability and social function.
- Numeral 27 of Article 6 of the Law contains the definition of the term “moratorium”, which is as follows: It is the failure to pay the common expense installments within the period established in the Co-ownership Regulations ; If this period is not defined, the last day of the month will be considered the payment deadline.
- Article 24 of Law 284 establishes that the owners of real estate units with shared elements will pay equally for the maintenance and repair costs of the elements of the mezzanines and walls that are common to them. If it is proven that the damage has been caused by one of the affected parties, they must assume the repair costs within a period of thirty calendar days .
- Numeral 4 of Article 28 of the Law stipulates that owners who are delinquent in the payment of common expense fees may be denied surveillance and security services, correspondence, porter service, permits for the entry of materials or permits for remodeling or construction in the unit.
- Article 46 of the Law creates, on a mandatory basis, the contingency fund to attend to and finance the obligations, works or expenses that arise and that are not contemplated in the current budget of the horizontal property and that, in addition, directly affect the financial situation and good financing of the property. The Contingency Fund corresponds to at least 1% of the total income and annual common expense fees collected, which must be included as part of the budget that will be approved at the annual ordinary meeting of the Assembly of Owners.
- Article 56 of the Law establishes the obligation of the owner to attend the meetings of the Assembly of Owners and that a fine of a minimum of 20% of the share of common expenses will be imposed on the owner who does not attend the meeting. of the Assembly of Owners. The Assembly of Owners may increase this percentage.
- Article 74 of the Law stipulates that the initial designation made by the promoter of the members of the Board of Directors must be renewed by the owners at the time of the transfer of 51% of all the real estate units that make up the real estate regardless of whether the project is carried out in stages or phases.
- Article 78 of the Law establishes that the members of the Board of Directors may resign, for any reason, from the positions that were elected by means of an explanatory note to the rest of the directors. The resignation must be formalized and registered by the resigning party in the Public Registry within a period of no more than 30 calendar days and will have the signature of the director who resigns. During this period, the director who has resigned must remain and hold office until his resignation is registered.
- Article 80 of the Law establishes that the Board of Directors is not authorized to exempt common expense fees, this includes surcharges, fines and extraordinary fees.
- Article 83 of the Law establishes that the members of the Board of Directors will not be personally, civilly, administratively or criminally liable for the actions they carry out in the exercise of their position and by mandate of the Assembly of Owners, in accordance with the Law. Likewise, the members of the Board of Directors may not be subject to civil precautionary measures of a personal nature or in their property, for the actions they carry out in the exercise of their position and by mandate of the Assembly of Owners.
- Article 92 of the Law stipulates that whoever holds the position of administrator of a condominium must have a managerial profile, with knowledge of human resources and labor regime, conflict resolution, accounting and the management of condominium legislation.
- Article 96 of the Law establishes that the administrator will not be personally, civilly, administratively or criminally liable for the actions he carries out in the exercise of his position and by mandate of the Assembly of Owners or the Board of Directors, in accordance with the Law. Likewise, he may not be subject to civil precautionary measures of a personal nature or in his property, for the actions he carries out in the exercise of his position and by mandate of the Assembly of Owners or the Board of Directors.
- Article 109 of the Law stipulates that it will be the justices of the peace who will have jurisdiction to hear and resolve situations or controversies that arise within the horizontal property between the owners and/or the owners with the administrator.

- Artículo 115 de la Ley establece que la administración de las unidades inmobiliarias informará mensualmente y por escrito, a las instituciones acreedoras de hipotecas y a fideicomisos, sobre las unidades inmobiliarias que mantengan atraso de dos meses o más en el pago de sus cuotas de administración, conservación y mantenimiento de bienes comunes y quienes estarán obligadas a recibir la notificación y actuar de acuerdo con las cláusulas del contrato de hipoteca.
- Los nuevos porcentajes para las diferentes situaciones:

- Artículo 19 de la Ley: La Asamblea de Propietarios podrá aprobar por el 51% o más de la totalidad de las unidades inmobiliarias que algunos bienes comunes tengan el carácter de exclusivos, bajo las condiciones que establezcan, para uno o más propietarios, siempre que no sean indispensables para la existencia, seguridad y conservación del inmueble, en cuyo caso corresponderá a este propietario o esos propietarios beneficiados con el uso exclusivo de esos bienes comunes los gastos de mantenimiento, reparación y conservación. En la anterior Ley 31 de 18 de junio de 2010, se estableció que el porcentaje era del 66% de todas las unidades inmobiliarias.
- Artículo 20 de la Ley: La Asamblea de Propietarios, en decisión tomada por el 51% o más de la totalidad de las unidades inmobiliarias, podrá aprobar la adquisición de un bien ofrecido por su dueño, para ser utilizado como bien común, para venta o arrendamiento en beneficio de la propiedad horizontal. En la anterior Ley 31 de 18 de junio de 2010 se estableció que el porcentaje era del 66% de la totalidad de las unidades inmobiliarias.
- Artículo 22 de la Ley: El coeficiente de participación sobre los bienes comunes será proporcional al valor de la unidad inmobiliaria de su dominio y deberá fijarse en términos de porcentaje del valor total. Las mejoras y menoscabos de cada unidad inmobiliaria no alteran la cuota atribuida, que solo podrá variarse con la aprobación del 51% o más de los votos de la totalidad de las unidades inmobiliarias. En la anterior Ley 31 de 18 de junio de 2010 se estableció que el porcentaje era del 66% de los votos de los propietarios de todas las unidades inmobiliarias como porcentaje mínimo.
- Artículo 35 de la Ley 284: La modificación de cuotas de gastos comunes ordinaria o la aprobación de cuotas de gastos comunes extraordinarias en primera convocatoria requerirá de la aprobación de la Asamblea de Propietarios mediante la votación favorable de, por lo menos, el 51% de la totalidad de las unidades inmobiliarias que se encuentren al día en el pago de las cuotas de gastos comunes En la anterior Ley 31 de 18 de junio de 2010 se estableció que la aprobación de la Asamblea de Propietarios se tenía que dar mediante la votación favorable de, como mínimo, el 66% de los propietarios de las unidades inmobiliarias que estén al día en sus obligaciones financieras con la propiedad horizontal.
De no lograrse el quorum reglamentario en la reunión de la Asamblea de Propietarios en primera convocatoria en donde se modifica la cuota de gastos comunes ordinaria o la aprobación de una cuota de gastos comunes extraordinaria, el secretario de la Junta Directiva o quien esté ejerciendo esta función levantará un acta dejando constancia de la situación y cualquier otro hecho relevante que deba ser conocido por los propietarios ausentes. Los presentes podrán establecer una nueva fecha para la celebración de una nueva reunión, la cual deberá ser convocada de acuerdo con lo establecido en esta ley con un mínimo de diez días calendarios después de la primera, con la misma agenda, horario, forma y lugar para tratar la modificación de la cuota de gastos comunes ordinaria o la creación de una cuota de gastos comunes extraordinaria. En la segunda convocatoria bastará con la aprobación de, como mínimo, el 30% de la totalidad de las unidades inmobiliarias que se encuentren al día en el pago de las cuotas de gastos comunes. En la anterior Ley 31 de 18 de junio de 2010 se estableció que, en caso de no lograrse la aprobación por inasistencia a la Asamblea de Propietarios, bastará en la segunda convocatoria con la aprobación de, como mínimo, el 33% de los propietarios de las unidades inmobiliarias que estén al día en sus obligaciones financieras con la propiedad horizontal.

- Artículo 36 de la Ley: Cuando se trate de mejoras adicionales a las ya existentes al momento de incorporarse la propiedad horizontal al Régimen de Propiedad Horizontal, para su aprobación se requerirá del voto favorable del 51% de la totalidad de las unidades inmobiliarias que se encuentren al día en el pago de las cuotas de gastos comunes. En la anterior Ley 31 de 18 de junio de 2010 se estableció que se requerirá de la aprobación del 66% de los propietarios de las unidades inmobiliarias que estén al día en sus obligaciones financieras con la propiedad horizontal.
